Agreement to Terms
By accessing or using the Avocadish app, you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you may not access the service.
Description of Service
Avocadish is a recipe management and meal planning application that allows users to import recipes, create meal plans, and generate shopping lists. We provide this service subject to the following terms.
User Accounts
When you create an account with us, you must provide accurate and complete information. You are responsible for safeguarding the password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
User Content
Our service allows you to post, store, and share content including recipes, meal plans, and shopping lists ("User Content"). You retain all rights to your User Content, and you are responsible for it.
By posting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, copy, modify, and display your User Content in connection with the service.
Intellectual Property
The service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Avocadish and its licensors. The service is protected by copyright, trademark, and other laws of the Netherlands and the European Union.
GDPR Compliance
We are committed to complying with the General Data Protection Regulation (GDPR). Please refer to our Privacy Policy for details on how we collect, use, and protect your personal data in accordance with the GDPR.
Statutory Rights
If you are a consumer resident in the European Union, you have certain statutory rights regarding contracts for digital content and services. Nothing in these Terms of Service is intended to affect your rights under Dutch and EU consumer protection laws.
Termination
We may terminate or suspend your account and access to the service if you breach these Terms of Service. We will provide notice when practical, in accordance with Dutch and EU regulations regarding digital services.
Limitation of Liability
Our liability is not excluded or limited in any way where it would be unlawful to do so under Dutch or EU law. This includes liability for death or personal injury caused by our negligence or for fraud or fraudulent misrepresentation.
To the extent permitted by applicable law, Avocadish shall not be liable for any indirect or consequential losses you may suffer. Our aggregate liability to you for any and all claims arising out of or relating to these Terms shall not exceed the amount paid by you for the service during the 12 months preceding the claim.
Changes to Terms
We reserve the right to modify these terms at any time. We will provide notice of material changes by posting the updated terms on this page and, where appropriate, notifying you by email. Continued use of the service after such changes indicates your acceptance of the new Terms.
Dispute Resolution
If you have a complaint, please contact us first at brandon@help.avocadish.com. We will do our best to resolve any disputes amicably.
For unresolved disputes, Dutch consumers may use the European Commission's Online Dispute Resolution platform available at https://ec.europa.eu/consumers/odr.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.
If you are a consumer, you additionally enjoy the protection of the mandatory provisions of the law of the country where you reside.
Severability
If any provision of these Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole.
