Terms of Service

Important: These Terms of Service ("Terms") constitute a legally binding agreement between you and Avocadish regarding your use of our mobile application and related services. Please read them carefully.

1. Acceptance of Terms

By downloading, installing, accessing, or using the Avocadish mobile application ("App"), you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not download, install, or use the App.

Your use of the App constitutes acceptance of these Terms as they may be modified from time to time. You must be at least 16 years old to use our services.

2. Description of Service

Avocadish is a mobile recipe management and meal planning application that enables users to:

Import recipes from websites, TikTok, and Instagram posts
Organize and store personal recipe collections
Create weekly meal plans
Generate automatic grocery shopping lists
Access premium features through Avocadish Plus subscription

Our services are provided through mobile applications for iOS and Android devices, supported by cloud-based backend services.

3. Software License Grant

Subject to your compliance with these Terms, Avocadish grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your personal mobile devices solely for your personal, non-commercial use. We may automatically update the App to improve functionality and security.

This license does not grant you any rights to:

Reverse engineer, decompile, disassemble, or attempt to derive source code
Copy, modify, adapt, or create derivative works of the App
Remove, alter, or obscure any proprietary notices or labels
Use the App for commercial purposes without express written permission
Distribute, rent, lease, or sublicense the App to third parties

4. User Accounts and Registration

To access certain features, you must create an account by providing accurate and complete information. You are responsible for:

Maintaining the confidentiality of your account credentials
All activities that occur under your account
Notifying us immediately of any unauthorized access or security breaches
Keeping your account information current and accurate

You may not create accounts using automated means or create multiple accounts.

5. User Content and Intellectual Property

You retain ownership of content you create or upload ("User Content"), including recipes, meal plans, shopping lists, and photos. However, by using our services, you grant Avocadish a worldwide, non-exclusive, royalty-free license to use, copy, modify, distribute, and display your User Content solely to:

Provide and improve our services to you
Enable sharing features you choose to use
Process content through our AI systems for recipe import and recommendations
Generate analytics and improve our algorithms (in anonymized form)

You represent and warrant that you have the right to grant this license and that your User Content does not infringe third-party rights.

6. Avocadish Plus Subscription

Avocadish Plus is our premium subscription service offering unlimited smart recipe imports and additional features. Subscription terms:

Subscriptions are processed through the App Store or Google Play
Payment is charged to your app store account at confirmation of purchase
Subscriptions automatically renew unless cancelled at least 24 hours before renewal
You can manage and cancel subscriptions in your app store account settings
No refunds for partial periods or unused portions

Subscription prices may change with 30 days' notice. Free trial periods, if offered, automatically convert to paid subscriptions unless cancelled.

7. Data Collection and Privacy

We collect and process personal data as described in our Privacy Policy, including:

Account information and usage analytics
Device information and crash reports (via Sentry)
Recipe content for AI processing and recommendations
Payment information (processed by third-party providers)

Our data practices comply with GDPR and Dutch privacy laws. For complete details, see our Privacy Policy.

8. Third-Party Services

Our App integrates with third-party services for authentication, content import, and analytics. We are not responsible for third-party services' availability or practices. Your use of these services is subject to their respective terms.

9. Prohibited Uses

You agree not to:

Use the App for illegal purposes or in violation of applicable laws
Attempt to gain unauthorized access to our systems or other users' accounts
Upload harmful code, viruses, or malicious content
Violate intellectual property rights of others
Spam, harass, or abuse other users or our support team
Use automated tools to access or scrape our services
Circumvent security measures or usage limitations

10. Service Availability

While we strive to provide reliable services, we do not guarantee uninterrupted availability. Our services depend on:

Internet connectivity and third-party infrastructure
Cloud services and content delivery networks
External APIs for recipe import functionality

We reserve the right to modify, suspend, or discontinue services with reasonable notice.

11. Termination

You may terminate your account at any time through the App settings or by contacting us. We may terminate or suspend your access if you violate these Terms, with notice when practical.

Upon termination:

Your license to use the App immediately ends
You must delete the App from your devices
We may delete your account data after a reasonable period
Surviving provisions include intellectual property, limitation of liability, and dispute resolution

12. Disclaimers and Limitation of Liability

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED.

Our liability is not excluded or limited where it would be unlawful under Dutch or EU law, including for death, personal injury, fraud, or consumer rights violations.

Subject to applicable law, our total liability for any claims shall not exceed the amount you paid us in the 12 months preceding the claim, or €100 if no payments were made.

13. Consumer Rights (EU/Netherlands)

If you are a consumer resident in the European Union or Netherlands, you have statutory rights that cannot be excluded, including:

Rights under Dutch Consumer Protection Act
GDPR data protection rights
14-day withdrawal right for distance contracts (where applicable)
Rights regarding defective digital content

Nothing in these Terms affects your statutory consumer rights.

14. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated through:

In-app notifications
Email notifications (if provided)
Updated terms posted on our website

Continued use after changes constitutes acceptance. If you disagree with changes, you must stop using our services.

15. Dispute Resolution

For any disputes, please first contact us at legal@avocadish.com. We will attempt to resolve disputes amicably.

EU consumers may use the European Commission's Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr

16. Governing Law and Jurisdiction

These Terms are governed by Dutch law. Disputes will be resolved in the competent courts of the Netherlands. Consumers retain protection under mandatory laws of their country of residence.
